1. Acceptance of Terms
By accessing or using Muzebook ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Muzebook is a business management platform for independent musicians and music professionals. The Service includes contact relationship management, event tracking, ticket sales, music catalog management, press kit tools, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Account Registration
You must create an account to use most features of the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this age requirement.
4. Subscriptions and Billing
Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
We use Stripe to process payments. By providing payment information, you authorize us to charge your payment method for all fees due. Subscriptions automatically renew unless cancelled before the renewal date.
We reserve the right to change subscription fees upon reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new fees.
5. Ticketing and Payments
If you use our ticketing features to sell tickets to your events, you agree to use Stripe Connect for payment processing. You are solely responsible for: (a) the accuracy of event information, (b) fulfilling obligations to ticket purchasers, (c) any refunds or disputes arising from your events, and (d) compliance with all applicable laws regarding ticket sales in your jurisdiction.
Muzebook charges a platform fee on ticket sales as disclosed at the time of setup. This fee is automatically deducted from your payouts.
6. User Content
You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant Muzebook a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of providing and improving the Service.
You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe any third-party intellectual property rights or violate any applicable laws.
7. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others
- Upload or transmit malicious code, spam, or harmful content
- Attempt to gain unauthorized access to the Service or its systems
- Impersonate any person or entity
- Engage in any activity that interferes with or disrupts the Service
- Resell or sublicense the Service without our written permission
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Muzebook and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MUZEBOOK DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUZEBOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL MUZEBOOK'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page and, where appropriate, notifying you by email. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
